Professionals within Legal and Compliance provide a wide range of services to our business units. They might help to structure a complex and sensitive cross-border transaction; advise on a new product introduction; develop a training program or defuse an investor dispute. They preserve the firm’s invaluable reputation for integrity and protect the firm from sanctions with policies and procedures that meet regulatory requirements around the world. They also strive to maintain cooperative relationships with governmental policy makers and the regulatory and self-regulatory agencies that govern the firm’s businesses.
Successful applicant will be part of a legal team advising a national banking association and a U.S. broker-dealer.
Specific duties will include:
Providing legal and regulatory guidance on deposit products, such as checking and savings accounts and bank deposit sweep programs, for wealth management client segments;
Providing advice and guidance on integrated digital offerings, which include both banking deposit products and wealth management products and services such as spending and budgeting tools;
Providing guidance on payment systems and platforms, including debit and credit cards and the mobile payments area, including on payment network issues and regulatory issues related to payments;
Assisting in the analysis and review of client fraud claims under Regulation E, the UCC and other applicable federal and state laws;
Reviewing and advising on marketing activities related to such products and services;
Interfacing with and advising senior business leaders on complex matters and initiatives;
Negotiating contracts with payment systems and related service providers;
Assisting in developing new products and services related to deposit products and payment platforms to wealth management clients in a manner consistent with regulatory expectations and risk management;
Collaborating with Compliance, Operational Risk and other control partners on business initiatives and advising on Regulation E, TISA, and Bank Consumer Protection laws as well as with other applicable laws and regulations; and
Working with Compliance and business units on policies and procedures related to deposit products, payment platforms and money movements in accordance with applicable laws and regulations.
5-10 years of experience as a practicing attorney in financial services law, bank finance or corporate law.
Ability to work collaboratively in fast-paced environment on multiple projects; ability to think strategically and to analyze and evaluate potential risks, including economic, legal and reputational.
Experience with private banking and/or wealth management and familiarity with bank regulations including Regulation E, TISA, and Bank Consumer Protection and other laws and regulations applicable to financial services preferred.
Private practice with top law firm and/or in-house legal experience advising clients on private banking and/or wealth management business and initiatives, and experience in supporting cross-functional strategic projects desirable.
