The Westchester Medical Center Health Network (WMCHealth) is a 1,700-bed healthcare system headquartered in Valhalla, New York. The WMCHealth Office of Legal Affairs is seeking two attorneys -- one with 7-10 years of experience, and another with 4-6 years of experience -- to serve as Associate General Counsel and Assistant General Counsel, respectively. Each candidate must have excellent interpersonal, contract drafting, and overall writing and communication skills. Each must be highly organized and able to independently manage competing demands, tight deadlines, and shifting priorities, but also know when to seek guidance. Excellent critical thinking skills, sound legal and business judgment, a sense of humor, and the ability to collaborate with management and the existing team of attorneys, is essential.
Although specific responsibilities and degree of supervision will vary according to years of practice and work experience, both attorneys will be responsible for supporting WMCHealth by providing legal counsel and drafting and negotiating agreements under the supervision of the Deputy General Counsel and the General Counsel, with responsibilities including those listed below:
Drafting, editing, and negotiating a full range of health care contracts, including agreements for clinical and administrative services, license agreements, purchasing agreements, employment agreements, clinical trial agreements, asset purchase agreements, real estate leases, capital leases, business associate agreements, and other documents related to the provision of clinical care and operation of a multi-facility health network.
Advising members of senior management, including c-level executives, on a variety of legal and compliance issues related to the Anti-kickback Statute, Stark Law, reimbursement, HIPAA, performance of clinical trials, and delivery of patient care.
Responding to regulatory audits, governmental inquiries, and requests for information, and supervising responses to Freedom of Information Law requests.
Collaborate with the Compliance, Purchasing, and Risk Management Departments.
Research complex legal issues related to health law, not-for-profit corporations, and New York State public benefit corporations.
Coordinate and supervise work of outside counsel.
